Public Work Concessions
Larrain y Asociados holds a leading place in this field. Since 1994 we have advised national and international consortia in the study of almost all concessions projects of public infrastructure and toll roads bid up to date, mainly in the execution and operation of a great number of public works under concession (roads, urban highways, hospitals, tunnels, among others).
Additionally, we have acted on behalf of national and international financiers in the process of financing over fifty projects, through bank loans or the issuance and placement of debt instruments, both in the local and international markets. The firm has ample experience in arbitral proceedings for the resolution of controversies between concessionaires and the Ministry of Public Works on the occasion of the construction and operation of the works.
Similarly, we have advised governments in South and Central America in the development of their laws and contractual framework of their public work concessions systems.
Advise to Consorcio de Salud Santiago Oriente S.A. Sociedad Concesionaria. Construction and exploitation of Hospital del Salvador and Instituto Nacional de Geriatría, which is a main Chilean Hospital to be built through the public works concession regime (the biggest under this system). Legal assistance to the client in all matters relating to contractual matters, relation with the authorities involved, getting permits, financial matters and corporate matters.
Representation of the most important international concessioned highways groups. The advices include the prepare all the contracts, construction and operation, the relations with the Ministry of Public Woks (MOP, State Administration) and with the environmental authorities. Among others:
Advised to Abertis S.A. (Route 60 CH. San Felipe - Llay Llay), the concession company in charge of the construction and operation of this toll road near Santiago.
Counsel to Acciona S.A. (Route 160), which is the construction consortium and the concessionaire that was awarded the construction of a 90 kilometres road in southern Chile.
We advised OHL, the concession company that was awarded the road Canopsa. Camino Nogales/Puchuncaví, located in V Region, with a total length of approximately 43 kilometres.
